Pavlenko Legal Group defended the interests of the Ukrainian company in the dispute for the amount of 79.8 million UAH.

The Pavlenko Legal Group team won a lawsuit at the Kyiv Economic Court of Appeal, successfully defending the interests of the client – PJSC Gaztranzit – in a dispute with the executive service for the amount of UAH 79.8 million.

The judicial dispute concerned the writing off of the shareholder’s dividends from the Client’s account, the right of claim on which the shareholders of PJSC Gaztransit had not yet arisen. Within the framework of this dispute, lawyers proved that the court of first instance violated the rights of the Client by mistakenly identifying and recovering its funds as a debtor-shareholder’s funds.

The project was accompanied by the head of the court practice of Pavlenko Legal Group Elena Pertsova, lawyers Grigory Pavlenko and Inna Skuz under the direction of Managing Partner Oleksandra Pavlenko.

“Despite all the procedural barriers, we managed to prove a clear violation of the Client’s rights. At the same time, the court not only took into account the violation of the norms of national legislation, but also supported our arguments about violation of the Convention for the Protection of Human Rights and Fundamental Freedoms and the First Protocol”, noted Oleksandra Pavlenko.

“The Pavlenko Legal Group team did a great job. We are proud of the fact that our work has been the basis of the court’s decision “, –  summed up Elena Pertsova.
